Welcome to MountainSide Contractors, LLC ("MountainSide," "Company," "we," "us," or "our"). MountainSide Contractors, LLC is a licensed, bonded, and insured construction company based in Albuquerque, New Mexico.

These Terms of Service ("Agreement") govern your access to and use of our website, forms, text messaging program, and related services (collectively, the "Services"), including but not limited to:

  • Residential and commercial concrete services
  • Masonry services
  • Stucco installation, repair, and replacement
  • Landscaping and hardscaping
  • Home additions and remodeling
  • Tenant build-outs and new development
  • Estimates, consultations, and scheduling
  • SMS and email communications

By accessing or using our Services, you agree to be bound by this Agreement.

1. Acceptance of This Agreement

1.1 Acceptance Through Use

By accessing or using any part of the Services, you agree — on behalf of yourself or the entity you represent — to be legally bound by these Terms.

1.2 Eligibility

You must be at least 18 years old to request services, enter into a contract, or opt into text messaging. By using the Services, you represent that you meet this requirement and have authority to enter into this Agreement.

1.3 Changes to Terms

We may update these Terms at any time. Continued use of the Services after updates are posted constitutes acceptance of the revised Terms.

2. Estimates and Consultations

2.1 Free Estimates

We provide free estimates for qualifying projects within our service area. Submitting a request through our website or by phone does not create a contract or obligate either party to proceed.

2.2 Estimates Are Not Final Pricing

Estimates are based on information available at the time of the site visit. Final pricing may change if:

  • Site conditions differ from what was observed or disclosed
  • Subsurface, drainage, or structural issues are discovered
  • Scope of work is changed at your request
  • Material costs change materially before work begins
  • Permitting or inspection requirements change

2.3 Estimate Validity

Unless otherwise stated in writing, estimates are valid for 30 days from the date issued.

3. Project Agreements Control

These Terms govern your use of our website and communications. They do not replace the written contract, proposal, or work order signed for a specific project.

Where these Terms conflict with a signed project agreement, the signed project agreement controls for that project.

4. Scheduling and Site Access

By scheduling work with us, you agree to:

  • Provide safe and lawful access to the work site
  • Disclose known underground utilities, irrigation lines, septic systems, or property line disputes
  • Obtain any required HOA approvals
  • Remove or secure personal property in the work area
  • Confirm you are the property owner or have written authorization from the owner

Scheduled dates are estimates. Weather, permitting, inspections, material availability, and prior project overruns may cause delays. We will communicate schedule changes as promptly as we are able.

5. Payments

  • Payment terms, deposits, and draw schedules are set out in your signed project agreement
  • Payment details are handled by our payment processor and are not stored on our servers
  • Financing, where offered, is provided by third-party lenders subject to their own terms and approval
  • Past-due balances may be subject to interest and collection costs as permitted by New Mexico law

Promotional offers, including the $200 discount on masonry and concrete services, are subject to minimum project values, cannot be combined with other offers unless stated, and may be modified or withdrawn at any time.

6. Licensing, Bonding, and Insurance

MountainSide Contractors, LLC is licensed, bonded, and insured in the State of New Mexico. Current license and insurance information is available on request.

7. Warranties

Warranty coverage is stated in your signed project agreement. Where a warranty is offered, including our stucco warranty, it is subject to the terms, exclusions, and duration set out in that agreement.

Warranties do not cover:

  • Damage from misuse, neglect, or failure to perform routine maintenance
  • Damage from acts of nature, ground movement, flooding, or seismic activity
  • Normal curing characteristics of concrete and masonry, including hairline cracking, color variation, and efflorescence
  • Work altered, repaired, or added to by another party
  • Pre-existing conditions or defects in adjoining structures

Except as expressly stated in a signed agreement, all other warranties, express or implied, are disclaimed to the extent permitted by law.

8. Acceptable Use of Our Website

You agree not to:

  • Violate any applicable law or regulation
  • Submit false, misleading, or fraudulent information through our forms
  • Submit another person's phone number or contact information without their consent
  • Infringe intellectual property rights
  • Attempt unauthorized access to our systems
  • Use automated tools to scrape, overload, or disrupt the site

9. Intellectual Property

All website content, photography, project galleries, logos, and marketing materials are the property of MountainSide Contractors, LLC or our licensors and may not be copied, reproduced, or redistributed without written permission.

Unless you tell us otherwise in writing, we may photograph completed work for portfolio, marketing, and advertising purposes. Photographs will not include identifying personal information or house numbers on request.

10. SMS and Text Messaging Terms

10.1 About Our Messaging Program

MountainSide Contractors, LLC operates a text messaging program for customers who request estimates or schedule construction services with us.

When you opt in to non-marketing messages, you can expect to receive:

  • Appointment confirmations
  • Appointment reminders
  • Reschedule and crew arrival notifications
  • Post-service follow-up
  • Account, estimate, and payment information
  • Customer service responses

When you opt in to marketing messages, you can expect to receive promotional discounts and deals, new service announcements, customer loyalty rewards, referral incentives, and re-engagement promotions.

10.2 Consent

By checking the SMS consent box on our web form, or by providing verbal consent when scheduling with us by phone, you agree to receive text messages from MountainSide Contractors, LLC at the mobile number you provide.

Marketing and non-marketing messages require separate opt-ins. You may consent to one, both, or neither. Consent to receive text messages is not a condition of purchase.

10.3 Cancellation and Opt-Out

You can cancel the SMS service at any time. Just text "STOP" to (505) 227-1782. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Opting out of text messages does not remove you from email communications or affect an active project. We may still contact you by phone regarding scheduled work.

10.4 Help

10.5 Message Frequency and Cost

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your project status and scheduling activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

10.6 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

10.7 Supported Carriers

Text messaging is supported on major U.S. carriers. Carrier support may change without notice.

10.8 No Sale or Sharing of Mobile Data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

11. Privacy

Your use of our Services is governed by our Privacy Policy. We do not knowingly collect information from children under 13.

12. Disclaimers

Our website and its content are provided "as is" without warranties of any kind. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Information on this website, including service descriptions, pricing, and project galleries, is for general informational purposes and does not constitute a binding offer.

13. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages arising from your use of this website or our communications.
  • Liability arising from construction work performed is governed by the signed project agreement for that project and by applicable New Mexico law.

Nothing in this section limits any liability that cannot lawfully be limited under New Mexico law, including liability for gross negligence or willful misconduct.

14. Indemnification

You agree to indemnify and hold MountainSide Contractors, LLC harmless from claims arising from:

  • Your misuse of this website or our Services
  • Information you submit that is false or that you had no right to submit
  • Your failure to disclose known site conditions, easements, or utility locations
  • Your failure to obtain required owner or HOA authorization

15. Dispute Resolution

This Agreement is governed by the laws of the State of New Mexico without regard to conflict of law principles.

Disputes arising from these Terms shall be resolved in the state or federal courts located in Bernalillo County, New Mexico.

16. Termination and Survival

We may suspend or terminate access to our website or messaging program at any time. Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
